Terms of Service

By accessing or using CollabDraw (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By creating an account or using any part of the Service, you confirm that you are at least 13 years of age and that you have read, understood, and accepted these Terms.

If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must notify us immediately at support@collabdraw.com if you suspect unauthorised access to your account. CollabDraw will not be liable for any loss arising from unauthorised use of your account.

You may not share your account with others or create accounts using automated means. Each account is for a single individual user only.

You retain full ownership of any content you create, upload, or store within the Service ("User Content"), including designs, drawings, images, and text. CollabDraw does not claim ownership over your work.

By using the Service, you grant CollabDraw a limited, non-exclusive, royalty-free licence to host, store, and display your User Content solely for the purpose of operating and providing the Service to you.

You are solely responsible for your User Content. You warrant that you have all necessary rights to the content you upload or create, and that your content does not infringe the intellectual property rights or other rights of any third party.

You agree not to use the Service to:

• Upload, create, or share content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable
• Infringe the intellectual property rights of others
• Transmit any unsolicited commercial communications (spam)
• Distribute malware, viruses, or any other malicious code
• Attempt to gain unauthorised access to the Service or other users' accounts
• Scrape, crawl, or otherwise harvest data from the Service without our written consent
• Use the Service in any way that violates applicable laws or regulations

CollabDraw reserves the right to investigate and take appropriate action against violations, including removing content and terminating accounts.

CollabDraw offers a free tier and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

By subscribing to a paid plan, you authorise CollabDraw to charge your selected payment method on a recurring basis. Prices are subject to change with reasonable prior notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

You may cancel your subscription at any time from your account settings. Upon cancellation, your paid features will remain active until the end of the current billing period, after which your account will revert to the free tier.

The Service, including its software, design, graphics, templates, and documentation, is owned by CollabDraw and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

Template designs included in the Service are provided for use within CollabDraw projects only. You may use, adapt, and publish work derived from these templates, but you may not resell or redistribute the templates themselves as standalone assets.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

CollabDraw does not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any loss of data, though we take reasonable measures to protect your content.

To the fullest extent permitted by applicable law, CollabDraw shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability to you shall not exceed the greater of £50 or the amount you paid to CollabDraw in the twelve months preceding the claim.

You may stop using the Service at any time and delete your account through your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

CollabDraw reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable laws.

Upon termination, all licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination will continue to apply.

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification to the email address associated with your account.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the Service.
